This Writ Petition has been filed seeking a direction to the respondents to revise the scale of pay based on the representation of the petitioners dated 05.12.2022 and reminder representations dated 25.11.2024 and 17.03.2025.

2. Heard the learned counsels on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. The brief facts of the case is as follows: 3.1. The petitioners are the retired employees of the third respondent co-operative society and their pay was fixed as per G.O.Ms.No.131 dated 04.06.1999. He submitted that the petitioners pay was reduced by the third respondent, however, the Joint Registrar passed orders to implement

G.O.Ms.No.131 dated 04.06.1999. As per the order of this Court in W.P.No.7834 of 2004, the first respondent issued circular to all the cooperative societies to take immediate steps to revise the pay and allowance by taking into consideration of the letter dated 04.04.2005. However, no action was taken. While so, the petitioners herein made representations to the respondents on 17.03.2022, 25.11.2024 and 17.03.2025 citing the orders passed by this Court in W.P.No.14158 of 2014, W.P.(MD) Nos.158 & 13900 of 2014. Till date, there was no response from the respondents.

4. Aggrieved by the same, the present Writ Petition has been filed.

The learned counsel for the petitioners drew the attention of this Court to the orders passed by this Court in identical issues in W.P.No.14158 of 2014, W.P.(MD) Nos.158 & 13900 of 2014 dated 10.10.2022 & 01.09.2022 respectively, wherein this Court has held that the Society has power to fix the salary to its own staff based on their financial status and viability and pursuant to the said orders, the respondents therein had implemented the orders of this Court. He further submitted that the petitioners herein are also similarly placed as that of the employees in W.P.No.14158 of 2014, W.P.(MD) Nos.158 & 13900 of 2014 and are entitled to the benefits of the said order. He also submitted that the petitioners herein

made representations to the respondents on 17.03.2022, 25.11.2024 and 17.03.2025 but no orders has been passed till date and hence, the present Writ Petition. Thus, he prayed this Court to pass appropriate orders.

Considering the facts and circumstances of the case and in the light of the orders passed by this Court as stated supra, this Court directs the third respondent to consider the representation of the petitioners dated 17.03.2025 and pass appropriate orders in accordance with law, if not already passed, within a period of six weeks from the date of receipt of a copy of this order.

7. With the above directions, this Writ Petition is disposed of. There shall be no orders as to costs.

8. WMP.No.55705 of 2025 filed by the petitioners to permit them to file the petition as a single Writ Petition is allowed subject to payment of separate court fee.
