PRAYER: Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus or direction in the nature of writ, forbearing the sixth respondent, the Sub-Inspector of Police, Thavalakuppam Police Station, Puducherry, namely V.Jayagurunathan, who is also impleaded as the seventh respondent in his personal capacity and any person acting under or on their behalf from interfering with or preventing the petitioner from carrying on their business of operating the marriage hall "Mayor Dharmalingam Thirumana Mahal" as the valid trade licence isued by the Commissioner, pursuant to the order dated 02.07.2025 of this Court.. Alleging that the sixth respondent, both in his official capacity as well as in his personal capacity, is interfering with the running of the business of the marriage hall and demanding a sum of Rs.75 lakhs to be paid to one Prithivirajan, the present petition has been filed seeking a direction to forbear the sixth respondent, in his official capacity as well as in his personal capacity and any person acting under or on his behalf, from interfering with or preventing the petitioner from carrying on the business of 2/6
running the marriage hall namely "Mayor Dharmalingam Thirumana Mahal".
Mr.M.V.Ramachandra Murthy, learned Public Prosecutor (Puducherry) takes notice on behalf of respondents 1 to 6. In view of the consent expressed by the learned counsel on either side, this Writ Petition (Criminal) is taken up for final disposal at the admission stage itself. Notice to the sixth respondent is dispensed with inasmuch as no order prejudicial to his interests is passed. Learned Senior Counsel appearing for the petitioner submitted that the petitioner is the owner of the marriage hall run under the name "Mayor Dharmalingam Thirumana Mahal" and that he has obtained all necessary permissions. He further submitted that Prithivirajan, who claims to be the nephew of the previous owner, is interfering with the petitioner's business and with the aid and collusion of the sixth respondent, is preventing the petitioner from running the said marriage hall. Hence, the present petition has been filed.

The sixth respondent, namely the Sub-Inspector of Police, Thavalakuppam Police Station, Puducherry, is present before this Court. Learned Public Prosecutor (Puducherry), on instructions from the sixth respondent, submitted that the sixth respondent is not interfering either in his official capacity or in his personal capacity with the petitioner's business. He further submitted that the allegation regarding the demand of money on behalf of the said Prithivirajan is also denied. He further reiterated that the sixth respondent is not interfering with the running of the business of the petitioner.
Recording the submission of the learned Public Prosecutor (Puducherry), this Writ Petition (Criminal) stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 06.01.2026 ham 4/6
