Ms.J.R.Archana, Government Advocate (Crl.Side) Order The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) & 326(a) of BNS Act, 2023 in Crime No.236 of 2025, on the file of the respondent Police, seeks anticipatory __________Page 1 of 4

bail.

2. The allegation against the petitioner is that he illegally quarrying 1/4 units of river sand in Shankarabarani river in a bullock cart. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that investigation in this case is still pending and no previous case has been registered against him. However, he oppose to grant anticipatory bail to the petitioner.

5. Earlier this Court dismissed the bail petition filed by the petitioner in Crl.OP.No.26386 of 2025 dated 25.09.2025 on the ground that the petitioner had illegally quarried sand and caused damage to the ecology and water body. However, there is no change in circumstances to revisit the earlier order established before this Court and this Court is not inclined to grant anticipatory bail to the petitioner.
