O R D E R

This writ petition (criminal) has been filed seeking to direct the respondents to take action on the petitioner's representation dated 28.10.2025 (referred to as 29.10.2025 by the petitioner in the prayer and petition averments), pending on the file of the 3rd respondent.

2. Mr.K.M.D.Muhilan, learned Additional Public Prosecutor, takes notice on behalf of the respondents 1 to 3. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself.

3. Since no order adverse to the interest of the 4th respondent is passed, notice to the said respondent is dispensed with.

Learned counsel for the petitioner submitted that the petitioner's son was brutally assaulted by one Lingesh and his associates, who also hurled invectives in filthy language and made caste-based remarks against him. Therefore, the petitioner made a complaint before the respondent police, pursuant to which, an FIR in Crime No.69 of 2025 came 2/5

to be registered, however, only for the minor offences under Sections 296(b), 118(1) and 351(3) of BNS and not for the major offences such as attempt to murder and caste-based invectives. Aggrieved by the same, the petitioner made a representation before the respondents on 28.10.2025, seeking to include necessary provisions under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also other offences. However, till date, no action has been taken on the said representation. Hence, the petitioner has come up with this writ petition (criminal).

5. Learned Additional Public Prosecutor appearing for the respondents 1 to 3, submitted that the petitioner's representation dated 28.10.2025 will be considered and appropriate action will be taken in accordance with law within the time stipulated by this Court,

In view of the above submission made by the learned Additional Public Prosecutor, this Court, without going into the merits of the case, directs the 3rd respondent to consider the petitioner's representation dated 28.10.2025 and take necessary action in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order, after conducting due enquiry.

7. This writ petition (criminal) stands disposed of accordingly. No costs.
