ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(b) r/w.20(a)(i) of NDPS Act in Crime No.410 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner was involved in planting 7 nos of ganja plants (papistal) on land belonging to him. When the plants grew up to 6 feet tall, the police were informed, and they searched the premises. However, the petitioner absconded from the place of occurrence. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner planted the tree without knowing its nature and is ready to cooperate with the investigation. Therefore, he prays for grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that 7 nos of ganja plants of 6 feet were grown by the petitioner. Hence opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that 7 nos of ganja plants of 6 feet were grown by the petitioner, and since it is a case of cultivation weighing 6.5 kgs, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
