IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 18-12-2025

CORAM

THE HONOURABLE MR JUSTICE M.DHANDAPANI P.Amulraj Petitioner(s) Vs

1. The Managing Director, The Tamil Nadu State Transport Corporation (Coimbatore) Limited, Head Office, No.37, Mettupalayam Road, Coimbatore-641 043 2.The General Manager State Transport Corporation (Coimbatore) Limited, Head Office, No.37, Mettupalayam Road, Coimbatore-641 043.

For Petitioner(s):

M/s.S. Vasavi Sridevi

For Respondents:

Mr.C.Gowthamaraj Standing Counsel

ORDER

Mr.C.Gowthamaraj, learned Standing Counsel takes notice on behalf of the respondents.

2.By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. This writ petition has been filed seeking a direction to the respondents to re-audit and re-compute the Earned Leave (EL) account of the petitioner for the month of November 2025, and consequently to cancel the wrongful imposition of two days of Loss of Pay (LOP) for November 2025, and to revise and disburse the petitioner's salary for November 2025 along with pensionary benefits, on the basis of the duly corrected leave position, in view of the petitioner's representation dated 09.12.2025, within a time frame to be fixed by this Court.

4. The case of the petitioner is that he served with the RespondentCorporation as a Special Grade Conductor and retired from service on attaining the age of superannuation on 30.11.2025, after 33 years and 8 months of unblemished and continuous service. At the time of retirement, the Earned

Leave (EL) account of the petitioner was erroneously computed by the Respondent-Corporation. As per the October 2025 pay slip, the petitioner had 12 days of EL, of which 10 days were surrendered for encashment, leaving a balance of 2 days. However, in the November 2025 pay slip, the RespondentCorporation wrongly reflected the EL balance as 3 days and treated 2 days as Loss of Pay (LOP), resulting in an unwarranted deduction in the petitioner's terminal salary. This error has directly impacted the fixation and settlement of the petitioner's pensionary benefits, including gratuity and monthly pension, despite the attendance details being correctly forwarded by the branch office. The petitioner submitted a representation on 09.12.2025 seeking rectification, but no action has been taken to date. Hence, the present writ petition has been filed seeking appropriate directions.

5. The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 1st respondent to consider the petitioner's representation within a reasonable time.

6.The learned Standing Counsel appearing for the respondents would submit that they will consider the petitioner's representation and pass appropriate orders within a reasonable time to be fixed by this Court.

7.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 09.12.2025 and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order, 8.With the above direction, this writ petition is disposed of. No costs. 18-12-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes uma
