O R D E R
This Writ Petition has been filed seeking a direction to the second respondent to implement the first respondent's order in Government Letter efile No.509/FR.2(i)/2024-3, dated 24.10.2024 to pay the monetary benefits from the date of joining as Forest Guard from 24.02.2012 till 23.10.2024 and as per Tamil Nadu Fundamental Rule 27(17) and in the light of the order passed in W.P.No.23478 of 2023 dated 27.03.2024, which was implemented by the first respondent in G.O.(2D) No.55, Environment, Climate Change and Forests (FR.2(ii)) Department, dated 26.03.2025, by considering the representation dated 13.12.2024.
2. Heard the learned counsels on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.
3. The submissions put forth by the learned counsel for the petitioner is as follows:
3.1. The petitioner's husband, who was appointed as Plot Watcher on 01.11.1981 on daily wages in the forest department, was brought into regular time scale as a Forest Watcher on 04.01.2000 and subsequently got promoted to Forest Guard on 24.02.20212, however overlooked by his junior one G.Venkatachalam in respect of regularization as well as promotion. Aggrieved over the same, he made representation to the respondent(s), since the same evoked no response, he filed W.P.No.30498 of 2013 & W.P.5836 of 2024 which were allowed with a direction to give notional regularization and promotion respectively with all consequential benefits.
Pursuant to the said order, the petitioner was given notional regularization and promotion on par with his junior, however other benefits were not granted in respect of regularization and promotion as per FR27(17). Therefore, the petitioner made a representation on 13.12.2024 to the respondents for implementation of the Government Letter dated 23.10.2024 and the order of this Court dated 07.03.2024. Since there was no response till date, the present Writ Petition has been filed.
4. Considering the facts and circumstances of the case, there shall be a direction to the first respondent to dispose of the petitioner's representation
dated 13.12.2024 and to pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition is disposed of. There shall be no orders as to costs.
