ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) of TNSC (RDCS) order 1982 r/w. 7(1)(a)(ii) of EC Act 1955 in Crime No. 208 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that he is ranked as A5 and is a member of the group that collects rice meant for PDS from various beneficiaries and sell it to other persons at higher prices. They collected five thousand kgs of PDS rice, and before handing it over to A5/the petitioner, they were caught by the police, and the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner was not aware of the activities of the other accused, and his name was added as an accused purely based on the confession given by them. He is not involved in the offence and is ready to cooperate with the investigation. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has another previous case of a similar nature, and the allegation reveals that the petitioner was waiting to collect the rice and is the owner of the rice. Hence, she opposed the grant of anticipatory bail to the petitioner.

Considering the manner in which the occurrence took place, the fact that the petitioner is the main accused who was waiting to collect the rice, the huge quantity of five thousand kgs of rice involved, the petitioner's previous case, and if the petitioner is granted bail there is likelihood that he will indulge

in similar offences, this Court is not inclined to grant anticipatory bail to the petitioner.
