For Petitioners :Dr.R.Gouri For Respondents : Mr.P.Balathandayutham, Special Government Pleader for R1 Mr.C.Gauthamaraj Standing Counsel for R2 to R4 COMMON ORDER Mr.P.Balathandayutham, learned Special Government Pleader takes notice on behalf of the 1st respondent and Mr.C.Gauthamaraj, learned Standing Counsel takes notice on behalf of the respondents 2 to 4. 2.By consent of both parties, these three writ petitions are taken up for final disposal at the stage of admission itself. 3.These three writ petitions have been filed seeking a direction to the 2nd and 3rd respondents to consider the petitioners' representation dated 12.09.2025 and consequently, to direct the respondents to confer promotion to the petitioner to the post of Assistant Manager fixing the petitioners' seniority retrospectively from the year 2012 with monetary benefits.
4 The case of the petitioners that they joined the service of the respondent Transport Corporation in the years 1993 and 1994 as Company Trainees, and they were regularised as Junior Engineers in the years 1994 and 1995. Thereafter, they were promoted to the post of Assistant Engineer in the years 2000, 2002, 2003, and 2005. Subsequently, they were conferred with promotion as Senior Assistant Engineer in the years 2006 and 2007. The petitioners have rendered 31 and 32 years of unblemished service in the Respondent Department. The petitioners have consistently made representations seeking consideration of their names for promotion to the next avenue of promotion to the post of Assistant Manager. It is on record, with candid admission by the Respondent Management itself, that the petitioners are in possession of B.
E Mechanical Degree Certificate issued by the Vinayaga Mission's Deemed University, Salem. Despite the petitioners having completed their B.E (Mechanical) part time course during the period 2008-2012, their names were not included in the seniority list prepared by the respondent Corporation. The petitioners made separate representations on 12.09.2025 to the respondent Management seeking promotion to the petitioners to the post of Assistant Manager by fixing their seniority retrospectively from the year 2012. However, the same has not been considered till date. Hence the present writ petitions have been filed.
5.The learned counsel for the petitioners would submit that it would suffice, if a direction is issued to the third respondent to consider the petitioners' representations seeking promotion to the post of Assistant Manager, within a reasonable time to be fixed by this Court.
6.The learned Standing Counsel appearing for the respondents 2 to 4 would submit that the 3rd respondent will consider the petitioners' representations and pass appropriate orders within a reasonable time to be fixed by this Court.
7.Considering the limited request made by the learned counsel for the petitioners, this Court, directs the third respondent to consider the petitioners' representations dated 12.09.2025 seeking promotion to the post of Assistant Manager, and to pass appropriate orders on merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
8. With the above directions, these three writ petitions stand disposed of. No costs.
