This Civil Miscellaneous Petition has been filed seeking leave to prefer an appeal against the order dated 15.10.2022 made in RLTOP No.118 of 2020 on the file of the learned Rent Controller and Principal District Munsif Court.
2. Heard the learned counsel for the petitioner.
3. The grievance of the petitioner is that the tenancy rights of the petitioner have been recognised from the year 2015 and that the petitioner has been running a business under the name and style of "Hi5 - The Smart Store." Despite the same, the first respondent has proceeded to file RLTOP No.118 of 2020 against the erstwhile tenant, namely, the second respondent, who had already vacated the tenanted premises.
4. According to the petitioner, taking advantage of the eviction order obtained against the erstwhile tenant, the first respondent is now attempting to disturb the peaceful possession of the petitioner.
5. In the light of the above submissions and upon perusal of the affidavit filed in support of this petition, as well as the reasons assigned therein, this Court is of the view that the petitioner has made out a case for grant of leave to challenge the order dated 15.10.2022 made in RLTOP No.118 of 2020. Accordingly, leave is granted as prayed for.
