ORDER
The writ petition is filed to consider the petitioner's representation dated 15.02.2025 and to take appropriate action in accordance with law, by enforcing the scheme decree of 1955 and pass on the summons. 2.Upon hearing the learned counsel for the petitioner, the grievance of the petitioner is that, the petitioner had made a representation by bringing to the notice of the Court with reference to certain allegations against one group of trustees and also about the expenditures incurred by them.
3. When the matter came up for hearing it is brought to the notice of the court that yet another person has already made the very same complaint before the authorities and that the same has been taken up for enquiry in
Na.Ka.No.15838/89/A9/Nagai dated 14.01.2026. Therefore, as the Executive Officer has posted the matter on 23.01.2026 for enquiry, it will be open for the petitioner also to participate in the enquiry tomorrow. The petitioner shall also submit a copy of his complaint and the same shall also be furnished to all the persons participating in the enquiry and whoever is interested in defending those allegations, shall defend the same.
4. The Chief Executive Officer shall conduct the enquiry into all the allegations made by the parties against each other and wherever he is fit enough, he can take action by himself and wherever action has to be taken by the Board, with his finding of facts, can submit the necessary report before the Waqf Board for further action. All the parties shall co-operate for the enquiry which is said to be happening tomorrow and the enquiry can also be continued on such date, as the Chief Executive officer may fix subsequently. The enquiry be completed as expeditiously as possible. It is open for the parties to place on record all the materials including the earlier orders of this court or such other materials, which are in their possession and make all submissions including the ones relating to jurisdiction.
