Respondent(s) Prayer: The Criminal Miscellaneous Petition filed under Section 528 of BNSS, 2023, praying to relax the conditions, imposed by this Court in Crl.M.P.No.11995 of 2018 in Crl.A.No.547 of 2018 dated 10.10.2018 that the petitioner shall report before the XI Additional Sessions Judge and Special Judge for CBI Cases (Banking and Financial Institutional Fraud) at 10.30.am. once in a month i.e. on the first working day of every month starting from November 2018.

ORDER

This petition has been filed to relax the conditions imposed by this Court in Crl.M.P.No.11995 of 2018 in Crl.A.No.547 of 2018 dated 10.10.2018 that the petitioner shall report before the XI Additional Sessions Judge and Special Judge for CBI Cases (Banking and Financial Institutional Fraud) at 10.30.am. once in a month i.e. on the first working day of every month starting from November 2018.

2.The learned counsel for the petitioner submitted that the petitioner is aged about 66 years and is facing difficulty in complying the condition in 2/4

view of his health ailments. Further the petitioner has been regularly appearing before the trial Court from the date of suspension order. Hence, prays to relax the condition.

3.The learned Special Public Prosecutor appearing for the respondent police submitted that the petitioner is complying with the conditions diligently from November, 2018.

4.Considering the fact that petitioner is aged about 66 years having age related health ailments and the submission made by the learned Special Public Prosecutor that the petitioner has been complying with the conditions diligently, the condition imposed on the petitioner to appear before the trial Court once in a month i.e. on the first working day of every month, is totally relaxed.
