ORDER

This writ petition has been filed by the petitioner seeking to direct the respondents 1 and 2 to consider the representation dated 05.11.2025 and direct the respondents 1 and 2 to execute a rectification deed. 2.Mr.G.Venkatesan, learned counsel takes notice on behalf of the respondents. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

3.Learned counsel for the petitioner would submit that the property in Plot No.1565, measuring to an extent of 122.0 sq.mts, situated at Door No.21, Old Door No.12, Periyar Street, MGR Nagar Scheme, Kodambakkam Village, Mambalam Taluk, Chennai - 600 078, was originally allotted to the petitioner's husband by the respondents 1 and 2 Department. After the demise of petitioner's husband, the respondents 1 and 2 executed a sale deed dated 11.03.2019 pertaining to the subject property in favour of the petitioner. Since there was some errors in the sale deed, based on the petitioner's request the respondents 1

and 2 executed a deed of rectification dated 27.11.2019. Subsequently, the petitioner sold the subject property to one Duraisamy under a sale deed dated 11.03.2019. Upon purchase of the subject property, the said Duraisamy applied for name transfer in patta and he came to know that the Block number and Town Survey number of the subject property has been wrongly mentioned as Block No.114 and T.S.No.150 instead of Block No.108 and T.S.No.120. 4.He would further submit that when the said Duraisamy made a representation to the respondents 1 and 2 to rectify the errors in the document. In response, the respondents 1 and 2 passed an order directing Duraisamy to approach the 3rd respondent for correcting the errors in the block and town survey numbers.

However, the 3rd respondent in his communication has pointed out that the person who has originally executed the sale deed can only be rectify the same and the Sub-Registrar cannot be on his own rectify the errors. Therefore, the said Duraisamy filed a writ petition in W.P.No.21419 of 2023 seeking direction to the respondents 1 and 2 to execute the rectification deed in his favour by correcting the block and town survey numbers. This Court vide order dated 04.11.2025, granted liberty to the said Duraisamy to approach his vendor i.e the petitioner herein for obtaining rectification deed. As per the liberty granted by this Court, the petitioner sent a detailed representation on 05.11.2025 to the 1st respondent to consider the request to rectify the errors in the block and town survey numbers of the subject property.

no steps have been taken by the 1st respondent. Hence, the present writ petition has been filed.

5.Learned counsel for the respondents would submit that the representation of the petitioner dated 05.11.2025 will be considered and disposed of at the earliest point of time.

6.Heard the learned counsel for the petitioner as well as the learned counsel appearing for the respondents.

7.Considering the submissions made by either parties and in view of the limited prayer sought for in this writ petition, this Court without going into the merits of the case, directs the respondents 1 and 2 to consider the representation dated 05.11.2025 made by the petitioner and pass orders on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.
