ORDER
This Criminal Original Petition has been filed seeking to file the final report in Crime No.2 of 2025, pending on the file of the first respondent Police. __________Page 1 of 4
2. The learned counsel for the petitioner submitted that the petitioner, along with one Ramesh/A5, filed a petition in Crl.O.P.No.16287 of 2021 seeking to quash the First Information Report. Though an order of stay was granted by this Court, the first respondent continued with the investigation and filed a final report referring the case in Crime No.1187 of 2021 as 'mistake of fact'
3. The learned counsel for the second respondent submitted that though the first respondent had filed a negative report, the petitioner had filed a protest petition seeking for further investigation, which was dismissed by the learned Judicial Magistrate. Thereafter, the second respondent approached this Court seeking further investigation and this Court set aside the final report and direct further investigation. This Court also transferred the case to CBCID for further investigation and the investigation is presently being conducted by the CBCID. He also submitted that the investigation has now reached a fag end. 4.The learned Government Advocate (Crl.side) appearing for the first respondent submitted that the investigation is presently being conducted by the CBCID. An extension of time was sought in Crl.M.P.23854 of 2025 and this Court, by an order dated 15.12.2025, granted a further period of three months to complete the investigation. He further submitted that the investigation is __________Page 2 of 4
being carried out in a fair manner and that the respondent will be able to file the final report within the said period of three months granted by this Court. 5.Taking into consideration the submissions made and the fact that the investigation is being conducted by the CBCID, this Court is not inclined to interdict the investigation. Accordingly, the first respondent is directed to continue to conduct the investigation in a fair manner and file the final report within the time frame fixed by this Court.
