ORDER

The above writ petition has been filed by the husband of the 5th respondent seeking a writ of certiorarified mandamus to quash the impugned legal heirship certificate dated 20.07.2021 bearing No. TN-7202106163072 dated 30.07.2021 issued by the 3rd respondent in respect of one late A.Pushparaj

and consequently to direct the second respondent to conduct thorough enquiry into the fraudulent act involved in issuing the legal hership certificate to the respondents 4 to 6.

2. The petitioner is the husband of the 5th respondent. The petitioner would contend that his father-in-law late A.Pushparaj had died on 10.05.2021 leaving behind his surviving wife, namely the 4th respondent and his only daughter, the 5th respondent as his exclusive legal heirs. The 6th respondent herein is the niece of the 4th respondent. The 6th respondent is neither the legal heir nor the biological daughter of late Pushparaj. However, the 4th respondent, wife of late Pushparaj, by suppressing the facts, had applied for a legal heirship certificate, including the name of the 6th respondent as his legal heir, before the office of the second respondent, and had obtained the same on 20.07.2021. The petitioner's contention is that the alleged act of the 4th respondent is only with an intention to usurp the property of the deceased Pushparaj.

3. It is the further contention of the petitioner that on account of this fraudulent act of the 4th respondent, there were fissures in his matrimonial life with the 5th respondent. These 4th and 6th respondents were influencing the 5th respondent and not allowing the 5th respondent to live with the petitioner. The 5th respondent, at the instigation of the 4th respondent, had filed an application for maintenance in M.C.No.580 of 2024 and also a petition for divorce in

O.P.No.518 of 2025, demanding a lumpsum amount from the petitioner. The petitioner would contend that he had filed a petition for restitution of conjugal rights in O.P.No.2568 of 2024, all of which are pending before the IV Additional Family Court, Chennai.

It is in this circumstances, the petitioner had come forward to submit his representation dated 11.07.2025 to the 1st and 3rd respondents for the cancellation of impugned aforementioned legal heirship certificate. Since no action was taken on his representation to date, the petitioner is before this Court.

5. Heard Ms.R.Rekha, learned counsel for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader for respondents 1 to 3 and also perused the material records.

6. The petitioner is not the legal heir of the deceased A.Pushparaj. He is only the son-in-law of late Pushparaj, being the husband of the 5th respondent. The petitioner's contention is that the 4th respondent had fraudulently added the name of her niece, the 6th respondent herein, in the legal heirship certificate. The 5th respondent who is the daughter of the deceased Pushparaj and the wife of the petitioner herein, had not raised any dispute or objection with reference to the issuance of legal heirship certificate, impugned herein. Be that as it may, the

petitioner has no locus standi to question the same. The action of the petitioner appears to be motivated. Therefore, the relief claimed by the petitioner cannot be granted.

7. With the above observation, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 12-01-2026 Index: Yes/No Speaking/Non-speaking order DS To :
