Respondents/Petitioners (Respondents 3 to 5 have attained majority) On representation of the learned counsel for the claimants, this case is taken up for settlement before the Lok Adalat. Mrs.G.V.Shoba, the learned counsel for the appellant and Mr.S.Babu, learned counsel for the

respondents are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The Respondents herein / Claimants have filed MCOP before the Tribunal against the Appellant herein / Transport Corporation praying for payment of a sum of Rs.25,00,000/-. The Tribunal passed an award directing the Transport Corporation to pay a sum of Rs.15,02,000/- with interest and costs. Aggrieved by the verdict passed by the Tribunal, the Transport Corporation has preferred an appeal before this Court.

2. During the course of the Lok Adalat proceedings, both the parties having initiated negotiations and successfully arrived at a settlement of all the issues arisen in this case.

3. The appellant herein / Transport Corporation has agreed to pay a sum of Rs.20,40,000/- in full quit, within a period of four weeks and the respondents herein have agreed to receive the above amount. Both the parties made a formal request to the Lok Adalat to pass an award in terms of the above settlement.

4. As a result, an award is passed hereby in terms of the above settlement arrived at between the parties by directing the appellant / Transport Corporation to pay a sum of Rs.20,40,000/- deducting a sum of Rs.25,000/- which has already been deposited before the Tribunal, in full

quit, within a period of four weeks.

5. The learned counsel for the respondents / Claimants has produced the original Transfer Certificates showing that the respondents 3 to 5 have attained majority.

6. The first respondent shall receive 30% of the above award, the respondents 2 to 5 shall receive 15% each of the above award and the respondents 6 and 7 shall receive 5% of the above award.

7. The Appellant / Transport Department is directed to deposit the aforesaid award amount within a period of four weeks from the date of receipt of a copy of this order.

8. On such deposit, the claimants / respondents are permitted to withdraw the compensation amount without filing any formal petition. The Award is passed accordingly.

9.The Tribunal is directed to issue the cheque to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. Mrs.G.V.Shoba Counsel for the Appellant
