ORDER
This petition has been filed seeking return of the passport to the petitioner, which was deposited before the trial Court pursuant to the order passed by this Court in Crl.O.P.No.27946 of 2023 dated 11.12.2023. 2.The learned counsel for the petitioner submitted that the petitioner is a businessman who used to travel regularly for his business activities. He has already obtained an order from this Court permitting renewal of his passport, and accordingly, this Court, by an order dated 28.07.2025, permitted the renewal of the passport before the learned Judicial Magistrate. Now, he seeks return of the passport, as retaining it before the Magistrate would prevent him from travelling. Hence, prays for modification of the said condition. 3.The learned Government Advocate (Crl.
Side) for the respondent police, by filing a counter, submitted that the petitioner was arrested at the time of the commission of the offence and that, if bail is granted, he may abscond and leave the country. It is further stated that the trial of LW.1 and LW.2 is posted for examination on 16.02.2026. Hence, he opposed modification of the condition.
4.I have also gone through the records and other connected materials.
5.Admittedly, the petitioner has deposited his title deeds and has roots in the country. He has also executed sufficient sureties to ensure his appearance before the trial Court.
6.In view of the above circumstances, this Court is inclined to modify the condition regarding deposit of the passport, and the petitioner is permitted to receive back his passport from the trial Court. 7.Accordingly, this Criminal Miscellaneous Petition is allowed. 12-02-2026 GBI
