..Respondent(s) PRAYER: Writ petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the Respondent to accept and register the Partition Deed dated 11/12/2025 typed and duly signed under Stamp Paper Number No.BH 885128 by the Writ Petitioners, upon receipt of necessary Stamp duty, based on the Lok Adalat Award No.333 of 2017 and dated 09/12/2017, arising out of O.S.No.395 of 2017 on the file of the Sub Court, Dharapuram and duly registered under DoC No.635 of 2018 on the file of the respondent.

ORDER

The petitioners had filed a suit for partition before the Subordinate Judge, Dharapuram in O.S.No.395 of 2017. On the basis of a settlement memo filed by the parties, an award was issued on 09.12.2017. Because the new survey numbers and boundaries were not recorded in the award, the petitioners state that they were constrained to file an application in the partition suit for amendment of the award. The said request was declined on the ground that the award of the Lok-Adalat cannot be modified. In those circumstances, the petitioners state that they executed partition deed dated 11.12.2025 and presented the same for registration. Because such request was orally declined, the present writ petition has been filed.

2. Mr.P.Harish, learned Government Advocate, accepts notice for the sole respondent. On the basis of instructions, he submits that the document was not presented for registration and that subject to fulfilment of requirements in relation to registration, such as payment of stamp duty and registration fees, further action would be taken by the registering officer. __________Page 2 of 4

3. Considering the above submissions, this writ petition is disposed of on the following terms:

(i) The petitioners shall re-present partition deed dated 11.12.2025 for registration within two weeks from the date of receipt of a copy of this order. (ii) Subject to remittance of requisite stamp duty and registration fees and fulfilment of any other requirements, the registering officer shall complete the registration within two weeks from the date of re-presentation.
