Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Certiorarified Mandamus, calling for records of impugned order vide Ref.No.TN/RO/AMB/PDC/201/1777117/000/7Q/LEVY ORDER/2024 dated 04.09.2024 passed by the respondent and quash the same and allow the petitioner to pay the amount of Rs.13,47,851/-(Rupees Thirteen Lakhs Forty Seven Thousand Eight Hundred and Fifty One only) in 18 equal monthly installments.

ORDER

The limited prayer in the writ petition is to pay the 7Q interest that is charged by the respondent authorities by way of instalments.

2. When the matter came up for admission today, Mr.P.K.Paneer Selvam, the learned counsel takes notice for the respondent would submit that the petitioner is not entitled to pay any instalments. Even if the Court is considering it on an equitable basis, a minimum of 5 to 6 instalments can be considered.

3. However, considering the overall facts and circumstances of the case, even though 18 instalments are prayed for on behalf of the petitioner, I am of the view that the petitioner can be permitted to pay the 7Q interest by way of 12 monthly instalments. The first instalment shall commence from February 2026 and shall be paid on or before 5th February 2026. Similarly, the remaining 11 equal instalments shall also be paid on or before the 5th of every succeeding calendar month.

4. Accordingly, the writ petition is ordered. Consequently, connected miscellaneous petition is closed. No costs.
