Prayer: This writ petition (criminal) has been filed under Article 226 of the Constituion of India seeking for issuance of a writ of mandamus to direct the first respondent to take necessary and appropriate action against the 4th and 5th respondents forthwith by considering the petitioner's representations / complaints, dated 16.09.2025 and 15.10.2025.

ORDER

This petition has been filed seeking to direct the first respondent to take appropriate action against the respondents 4 and 5 forthwith by considering the petitioner's representations / complaints, dated 16.09.2025 and 15.10.2025.

2. When the matter was taken up for hearing today, the learned Government Advocate (Crl.Side) appearing for the respondents 1 to 4 submitted that the complaints dated 16.09.2025 and 15.10.2025 given by the first respondent were, in turn, referred to the third respondent for enquiry and the same have been closed.

3. At this juncture, the learned counsel for the petitioner submitted that the petitioner had made specific allegation against the fourth respondent for colluding with the fifth respondent and harassing the petitioner. However, the

enquiry was conducted by the third respondent. She further contended that the enquiry was not conducted in a fair and proper manner and that the petitioner was not even called upon to participate in the enquiry.

4. In view of the above submissions made by the learned counsel for the petitioner, particularly that the petitioner was not afforded an opportunity of hearing, the closure report is hereby set aside. The Deputy Superintendent of Police, Perambalur, is directed to consider the representations of the petitioner dated 16.09.2025 and 15.10.2025 and conduct enquiry afresh, and file a report within a period of four (4) weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition (criminal.) stands disposed of.
