ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c) r/w. 20(b)(ii)(B) and 29(1) of NDPS Act in Crime No.313 of 2025, seeks anticipatory bail.
2. The allegation against the petitioner is that A1 purchased ganja to the extent of 1.1 kg from A3/the petitioner herein by giving Rs.3,000/- and sell the same to A2. Hence, the complaint is registered.
3. The learned counsel for the petitioner would submit that based on the confession statement of A1, the petitioner has been falsely implicated in this case. Therefore, he prays for grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has one previous case of similar nature and the investigation in this case is pending. Hence opposed to grant anticipatory bail to the petitioner.
5. Considering the fact it is a case of transportation of ganja and the petitioner has one previous case of similar nature, and if the petitioner is granted bail there is a likelihood that he will indulge in similar activities, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
