The above Writ Petition has been filed to issue a writ of certiorarified mandamus to call for the concerned records relating to the order No. X/K/M/5/10464/2023 dated 31.07.2024 passed by the 1st respondent and quash the same and consequently direct the 1st respondent to issue an integrated certificate to the petitioners.
2. The brief facts are as follows:
The 1st petitioner's husband, G.Ramakrishnan was employed as Line Inspector in the Office of the Junior Engineer (O&M), Aanaibogi Division in the Tamil Nadu Generation and Distribution Corporation Limited (TANGEDCO). He had died in the harness on 19.09.2021 leaving behind his wife, the 1st petitioner, two daughters, Anitha (the 2nd petitioner) and Ashwini and a son, Ajith Kumar. The 1st petitioner had requested the 1st 2/6
respondent to issue an integrated certificate. Her son, Ajith Kumar, who is married, is living with his family at Krishnagiri wherein he is employed as a Gangman. The 1st petitioner would submit that an application was made seeking compassionate appointment of the 2nd petitioner in the place of her deceased husband. The 1st respondent rejected the request for issuance of an integrated certificate on the ground that that the son was already in Government service and therefore, another member of the family cannot be considered for appointment and therefore, the integrity certificate cannot be issued. Challenging the same, the petitioners have preferred the above writ petition.
3. Heard the rival submissions made by the learned counsel appearing on either side.

A mere perusal of the impugned order would clearly demonstrate the non application on the part of the 1st respondent. The 1st respondent has overlooked the legal heirship certificate dated 12.11.2021 issued in Certificate No.7202110211550 by the 1st respondent in respect of the said Ramakrishnan. Having issued such a certificate, the refusal to grant the integrated certificate is unexplainable. That apart, the 2nd 3/6
petitioner, who is the daughter of the deceased employee, requires the certificate for submitting her application for appointment on compassionate grounds. The impugned order has been passed without perusing the records and hearing the petitioners. Therefore, the impugned order cannot be sustained and is accordingly set aside. Consequently, the writ petition is allowed. The 1st respondent is directed to consider the application of the petitioners afresh and pass orders on merits and in accordance with law, after affording an opportunity of personal hearing, within a period of one month from the date of receipt of a copy of this order.
