Judgment The captioned Civil Miscellaneous Appeal is filed to set aside the judgment and decree dated 12.10.2012 made in MCOP.No. 563 of 2009 on the file of Motor Accident Claims Tribunal (Sub-Court), Kanchipuram.
2. The learned counsel for appellant submitted that this court remanded back the connected claim petitions to the Tribunal and the same were settled before the Lok Adalat. Hence, this matter may also be remanded back to the Tribunal for amicable settlement. However, it is mentioned that the default period may also be taken note of.
3. In view of the above, this Civil Miscellaneous Appeal is remanded back to the Sub-Court, Kancheepuram to consider the claim of appellant and to decide the case in accordance with law. However, the learned counsel for 2nd respondent seeking to waive the interest for the delay period. In such circumstances, it is made clear the appellants are not entitled for interest for the default period. No costs.
