O R D E R

The petitioner is the owner of a portion of the property situated in Survey No. 65A/2A1A. This property of 65/2A1A of Palanthinnipatti Patti, Rasipuram Taluk, Namakkal District.

2.According to the petitioner, the access to his property is through a 20 feet passage, which runs in front of his property. The cause of action for the writ petition is that the respondents 4 and 5 are constructing a public toilet in the said 20 feet passage.

3.When the matter came up for admission, Mr.M.Shajahan takes notice for 1st to 3rd respondents and Mr.V.Venkata Seshaya takes notice for 4th and 5th respondents.

4. Mr.M.Shajahan has been instructed to report that the toilet is not being constructed on the 20-feet road, but on the other side of the said 20 feet road, which is opposite to the petitioner's property. Since the respondents 4 and 5 states that they are not constructing on the 20 feet road, the grievance of the petitioner does not arise. Suffice it to record the statement.
