The petitioner challenges the show-cause notice dated 14.11.2025 issued by the respondent viz., Assistant Executive Engineer, Water 1/4

Resources Organisation.

2. Heard Mr.S.Lakshmipathy, learned counsel for the petitioner and Mr.Yogesh Kanndasan, learned Special Government Pleader for the respondent.

On a perusal of the show-cause notice it is seen that it has been issued pursuant to the direction of this Court vide order dated 25.09.2025 in W.P.No.26633 of 2012 wherein the petitioner sought for a declaration that the proceedings initiated by the third respondent against the petitioners under the Tamil Nadu Public Premises (Eviction of Unauthorised Occupants) Act, 1975 (Act I of 1976) as illegal, void and without jurisdiction. While disposing of the said writ petition, this Court directed the third respondent to handover the entire files to the Assistant Executive Engineer and in case there is no Assistant Executive Engineer available in the Bhavanisagar Dam Division, directed the Government to appoint an Estate Officer in Bhavanisagar Dam Division for the purpose of issuing notice and follow the legal procedures for evicting the petitioner under Section 3 of the Act and only pursuant to the said direction, now the showcause notice has been issued. 2/4

4. When the Court was about to dismiss the writ petition, the learned counsel for the writ petitioner submitted that the petitioner is ready to vacate the premises, provided some time is granted.

5. In such view of the matter, though this Court is not inclined to entertain this writ petition, as the writ petitioner seeks some time to vacate the premises, two months time is granted to vacate and handover the premises. In case the petitioner does not vacate the premises within this two months time, as undertaken before this Court, the respondent shall summarily vacate the petitioner without recourse to any further proceedings.

6. With the above direction, this writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. There shall be no order as to costs.
