ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard.
2. The allegation through this petition is that the 4th respondent, while constructing a temple, has encroached upon the public street.
3. Learned counsel for the 4th respondent denies the allegation by submitting that no such encroachment has taken place.
4. Learned counsel for the Corporation would submit that taking cognizance of the complaint, an enquiry has been opened to verify the
allegation and notices have already been issued to the 4th respondent to produce relevant documents, whereafter proper examination would take place and appropriate action, as warranted under the law, would be taken.
5. In view of the statement so made and as notices have already been issued to the 4th respondent, we are not inclined to keep this petition pending. The authorities shall make necessary enquiry and due verification of the allegation. The 4th respondent would be entitled to have an opportunity of hearing. After drawing proper proceedings, the authorities shall conclude the same one way or the other, within the outer limit of four months.
