ORDER
This writ petition has been filed by the petitioner seeking to forbear the 1st respondent from opening the tender documents in respect of the work of strengthening at Km 0/9-9/9 and 10/2 - 11/020 of Shoolagiri-Uddanapalli road (M-1245) -(Job No.TN-CRIF 2025-26-SLM-18) in Tender Notice No.20/HDO/NH/2025-26/ dated 03.12.2025 of the 1st respondent herein without issuing the "Work Site Inspection Certificate" and "Working Condition of the Plants and Machineries Certificate" to the petitioner. 2.Learned counsel for the petitioner would submit that the 1st respondent has invited tender for various works, including the work of strengthening at Km 0/9-9/9 and 10/2 - 11/020 of Shoolagiri-Uddanapalli road (M-1245) -(Job No.TN-CRIF-2025-26-SLM-18). As per the tender condition, submission of a Work Site Inspection Certificate and Working Condition of Plants and Machineries Certificate issued by the 2nd respondent is mandatory. Therefore, the petitioner approached the 2nd respondent seeking issuance of the required certificates. However, the officials of the 2nd respondent refused to receive the
application, did not inspect the machineries and failed to issue the certificates despite repeated requests. The last date for submission of tender was fixed as 05.01.2026 and the bids were scheduled to be opened on 06.01.2026. The petitioner has also sent a representation dated 05.12.2025, in this regard to the 2nd respondent, which is not acted upon.Hence, the present writ petition is filed. 3.Mr.Yogesh Kannadasan, learned Special Government Pleader, who takes notice on behalf of the respondents would submit that the representation of the petitioner has been forwarded to the Divisional Engineer, Quality Control, National Highways, Salem for verification of working condition of the plants and machineries of the petitioner. After verification, the Work Site Inspection Certificate will be issued in accordance with law on or before 30.12.2025. In this regard, he placed the status report issued by the 2nd respondent before this Court.
4.Heard the learned counsel for the petitioner as well as the learned Special Government Pleader appearing for the respondents and perused the materials available on records.
5.In view of the above, recording the submissions made by the learned Special Government Pleader appearing for the respondents and the status report issued by the 2nd respondent stating that the petitioner work site and the working
condition of the plants and machineries will be inspected and the Work Site Inspection Certificate will be issued in accordance with law on or before 30.12.2025, this writ petition stands closed. No costs. Consequently, connected miscellaneous petitions are closed.
