Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records of the impugned order passed by the 2nd respondent dated 30.06.2025 vide proceedings in Moo.Mu.A7/820/2025 and quash the same and consequently direct the 2nd respondent to issue proper patta with respect to the petitioner's land measuring an extent of 4 cents, comprised in Survey No.20/1M of Sarvarajanpettai Village, Kattumannarkovil Taluk, Cuddalore District, forthwith.

ORDER

This Writ Petition has been filed challenging the impugned order, dated 30.06.2025 passed by the 2nd respondent, rejecting the petitioner's application seeking for issuance of patta in the name of the petitioner for the property morefully described in the prayer to this writ petition.

2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 4 and Mr.K.Karthikeyan, learned Government Advocate, accepts notice on behalf of the 5th respondent. Page No.2 of 6

3. The respective learned counsels appearing for the respondents 1 to 5 would submit that the petitioner will have to file a statutory appeal before the concerned District Revenue Officer (DRO), Cuddalore, if he is aggrieved by the impugned order, dated 30.06.2025 passed by the 2nd respondent.

4. The learned counsel appearing for the petitioner, on instructions, would submit that the petitioner is willing to file an appeal before the DRO, Cuddalore, against the impugned order, dated 30.06.2025 passed by the 2nd respondent.

5. No prejudice would be caused to the respondents, if a direction is issued to the petitioner to challenge the impugned order dated 30.06.2025 passed by the 2nd respondent by filing an appeal before the DRO, Cudalore, within a time frame to be fixed by this Court and a direction is also issued to the said DRO to dispose of the said appeal, on merits and in accordance with law, within a time frame to be fixed by this Court, by adhering to the principles of natural justice.

6. Since the District Revenue Officer, Kattumannarkoil, Cuddalore District has not been arrayed as party respondent in this writ petition, the Page No.3 of 6

District Revenue Officer, Kattumannarkoil, Cuddalore District is suo-motu impleaded as 6th respondent in this writ petition by this Court. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the newly impleaded 6th respondent as well. The Registry is directed to carryout the necessary amendment in the cause title.

7. For the foregoing reasons, this Court directs the petitioner to file the statutory appeal as against the impugned order, dated 30.06.2025 passed by the 2nd respondent, before the newly impleaded 6th respondent, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said appeal within the stipulated time, the 6th respondent shall pass final orders on merits and in accordance with law, after hearing the objections of the 5th respondent and any other third party, whom the 6th respondent deems fit to enquire, and by adhering to the principles of natural justice, within a period of six (6) weeks thereafter.
