COMMON ORDER (Order of the Court was made by S.M.Subramaniam J.) Writ of mandamus has been instituted to direct the 1st respondent to consider the representation submitted by the petitioners on 08.12.2025.
2. During inspection, encroachments are identified in Government Poramboke land in Kamaraj Government Hospital campus. Since hospital campus has been encroached upon, authorities have initiated enforcement action for eviction of encroachers, pursuant to the directions issued by this Court in batch of writ petitions in WP.Nos.14915 of 2025 et., batch, dated 29.04.2025.
3. Encroachments inside the Government Hospital campus would cause prejudice to the interest of the hospital activities. Therefore, eviction proceedings initiated cannot be stalled. Authorities are bound to evict all the encroachers from the Government hospital campus.
4. Learned counsel for the petitioner would submit that representations are submitted to provide alternate accommodation to the petitioner.
5. In this regard, authorities have to verify the status of the encroachers and if they are landless poor people, then their cases may be considered for providing alternate accommodation under any one of the welfare scheme and
by strictly following the terms and conditions stipulated by the Government.
6. It is needless to state that welfare State has to protect the livelihood of the landless poor persons. Therefore, if encroachers are identified as landless poor person, then their cases are to be considered for grant of alternate accommodation. However, encroachments cannot be allowed inside the Government Hospital campus. For providing alternate accommodation, eligible persons have to submit applications, which is to be considered on merits. As far as encroachments are concerned, it is no way connected with providing of alternate accommodation. Therefore, authorities are directed to complete the enforcement action and remove the encroachments from the hospital campus within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, the writ petitions are disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed.
