ORDER

This writ petition has been filed challenging the impugned order dated 20.11.2025 passed by the third respondent classifying the property morefully described in the prayer to this writ petition as Anadheenam land.

2. The petitioner has already filed a civil suit with regard to the very same property to declare that the petitioner is the absolute owner of the property and that the said property is not an Anadheenam land as stated by the respondents.

3. With regard to very same cause of action, when the civil suit is pending, the question of entertaining this writ petition does not arise. The petitioner had filed the civil suit even prior to the passing of the impugned order dated 20.11.2025. The respondents are also party defendants in the said civil suit. In view of the same, the relief sought for in this writ petition cannot be entertained by this Court while exercising its power under Article 226 of the Constitution of India. The remedy available to the petitioner is only before the

Civil Court where the civil suit filed by him is pending.

For the foregoing reasons, since the civil suit is pending for the very same cause of action, this writ petition is not maintainable, and accordingly, this writ petition is dismissed by granting liberty to the petitioner to raise all the objections that have been raised in this writ petition before the Civil Court, where the civil suit filed by him is pending. No Costs. W.M.P.No.5013 of 2026 is closed.
