ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 75(1)(ii) of BNS, 2023 and section 5(1), 5(n), 5(j)(ii) and 6(1) of the Protection of Child from Sexual
Offences Act, 2012 in Crime No.386 of 2025, seeks anticipatory bail.

The allegation against the petitioner is that the petitioner is relative of the victim aged about 17 years, developed a relationship with her and subsequently forced her to have intercourse, thereby committing aggravated penetrative sexual assault, which resulted in pregnancy. Hence, the complaint has been lodged.
3. The learned counsel for the petitioner would submit that the petitioner is only a relative and that a false complaint has been lodged, and he is ready to cooperate with the investigation. Therefore, he prays for grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the victim girl has delivered the child and the investigation is pending. She further submitted that even the statement of the victim under section 183(6) of the BNSS is yet to be recorded. Hence opposed to grant anticipatory bail to the petitioner.
5. Considering the fact that the petitioner committed aggravated
penetrative sexual assaulted on the victim girl aged about 17 years, which resulted in pregnancy, and she has now delivered a baby, and the investigation in this case is only a primary stage, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
