PRAYER: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to consider the petitioner's representations dated 05.02.2024, 25.03.2025, and 03.12.2025 for revocation of his suspension, in the light of the orders issued to the Accused Officer 2 dated 30.09.2025, within a reasonable period as may be fixed by this Court. Mr.A.Tamilvendan, learned Government Advocate takes notice on behalf of the respondents 1 to 3.

2.By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3.This writ petition has been filed, seeking a direction to the 1st respondent to consider the petitioner's representations dated 05.02.2024, 25.03.2025, and 03.12.2025 for revocation of his suspension, in the light of the orders issued to the Accused Officer 2 dated 30.09.2025, within a reasonable period to be fixed by this Court.

4.The case of the petitioner is that he was appointed as Deputy Registrar of Co-operative Societies through TNPSC in May 2010 and was initially posted at Villupuram Circle and is now working in Pollachi Circle. His next promotion

is Joint Registrar of Co-operative Societies due in 2021-22 panel, wherein his junior Thiru.A.Alagiri was promoted as Joint Registrar of Co-operative Societies. During the year 2021, the Government has given the benefit of crop loan waiver scheme. One C.Shivaji, Secretary of the Thalavaipalayan Primary Agricultural Society, Thondamuthur, Anamalai Taluk, Coimbatore District prepared a list containing fake claims and therefore, the petitioner refused to approve the said list of beneficiaries under the crop loan waiver scheme. However, the Secretary obtained approval of Thiru.A.Palanisamy, the then Joint Registrar of Cooperative Societies, Coimbatore Region, without the approval of the Deputy Registrar of Cooperative Societies concerned, i.e the petitioner herein. To escape from this misconduct, C.

Shivaraj, to avoid the enquiry proceedings, in connivance with the then Joint Registrar, stage-managed a trap. The DVAC officials have also filed an FIR on 19.02.2021, without any application of mind, simply on the statements made by the real accused C.Shivaji, Secretary of Thalavaipalayan Primary Agricultural Society, Thondamuthur, Anamalai Taluk, Coimbatore District, and S.Arumugam, the then Cooperative Sub Registrar, Pollachi Circle, now posted as Cooperative Sub Registrar in Thanjavur Region, revoking his suspension order dated 30.09.2025 has also been abused in this issue. The petitioner is not concerned with any misconduct, and no money has been recovered from him.

The 1st respondent has placed the petitioner under suspension in G.O.(2D) No.14, Cooperation, Food and Consumer Protection Department dated 04.03.2021, on the complaint made by the Secretary and on the bald and blind action of the DVAC which filed an FIR on 19.02.2021. The suspension order has not been revoked till date, inspite of his repeated representations even though it is unsustainable under law on the ground that, i) it is only a xerox copy , ii) the original suspension order was never served on the petitioner and it is not a valid document, in the light of the orders issued by the Government in G.O(Ms) No.97,P & AR Department dated 21.08.2022 and iii) the Accused Officer 2, Thiru.S.Arumugam, CSR has been used as a tool in this conspiracy. Further, C.Shivaji, Secretary of the Society was reinstated in service on 30.09.

Therefore, it is proved beyond doubt that the petitioner has been made as the scapegoat by Thiru.Palanisamy, the then Joint Registrar of the Society, abusing their position, in connivance with S.Arumugam, CSR along with C.Shivaji, the Secretary of the Society. Therefore, the petitioner made his representations on 05.02.2024, 25.03.2025, 03.12.2025 for revocation of his suspension from 04.03.

taken by the DVAC officials after filing the FIR on 19.02.20212, ii) the 1st respondent have sanctioned 75% of his pay and subsistence allowance, iii) the suspension order itself is incurably defective and non-est in law, iv) the Additional Registrar of Cooperative Societies have revoked the suspension of Accused Officer.2 Thiru.S.Arumugam, Cooperative Sub Registrar vide proceedings dated 30.09.2025 and posted him at Thanjavur Region for placement and v) the prolonged suspension is bad in law and the 1st respondent has failed to review his suspension as per the orders issued by the Government in G.O(Ms) No.30, P & AR Department dated 23.02.2013. However, the same were not considered till date. Hence the present writ petition has been filed. 5.The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the first respondent to consider the petitioner's representations seeking revocation of his suspension order, within a reasonable time to be fixed by this Court.

6.Considering the limited request made by the learned counsel for the petitioner and without expressing any opinion on the merits of the case, this Court, directs the first respondent to consider the petitioner's representation dated 05.02.2024, 25.03.2025 and 03.12.2025 seeking revocation of suspension order, and to pass appropriate orders on merits and in accordance with law

within a period of six (6) weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition stand disposed of. No costs.
