ORDER

This petition has been filed seeking a direction to the Respondents to count 50 percentage of the temporary /daily wage service rendered by the petitioner from 01.06.1997 till the date of Regularization as qualifying service for pension add the same to his regular service and grant pension and all consequential pensionary benefits.

2. It is the case of the petitioner that the petitioner was initially appointed as temporary worker on daily wage basis in the post of Driver under the control of Public Works Department and subsequently his service was regularised in the year 2009 but did not consider his 50% of service period as pension. Hence, the petitioner filed a present writ petition before this Court.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to count 50% of the temporary/daily wage service rendered by the petitioner from the date of entry into service till the date of regularization within the stipulated time as fixed by this Court.

4. The learned Special Government Pleader submitted that the petitioners

request will be considered in the manner known to law.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the petitioner to make a fresh representation to the respondents along with all the relevant documents and also a copy of this order within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the same, the second respondent shall consider and pass orders on the petitioner's representation . within a period of six weeks, thereafter.
