The petitioner, who was arrested and remanded to judicial custody on 11.06.2025 for the offences punishable under Sections 64(2)(m), 64(2)(f) of BNS, Sections 5(l), 5(n), 5(j)(ii) r/w 6(1) of Protection of Children from Sexual Offences (POCSO) Act in Spl.S.C.No.199 of 2025 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Tiruvannamalai, seeks bail. The earlier bail petition of the petitioner was dismissed by this Court, vide order dated 13.11.2025 in Crl.O.P.No.30924 of 2025. 2.

The case of the prosecution is that, the petitioner herein, who is the brother of the minor victim girl had committed penetrative sexual assault on her. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 11.06.2025; that after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.30924 of 2025, the investigation of this case has been completed and final report filed in Spl.S.C.No.199 of 2025; that the trial has commenced and charges were also framed; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail 2/4

to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police while opposing the bail to the petitioner reiterated the prosecution case and on instructions submitted that the victim girl has became pregnant; that the investigation of this case was completed and final report filed in Spl.S.C.No.199 of 2025 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Tiruvannamalai; and that the trial has commenced.

I have considered the submissions made on both sides and perused the materials available on record. Though, it is stated that the charges have been framed in this case and the trial has commenced, considering the gravity of offence and the relationship between the petitioner and the victim girl, if the petitioner is enlarged on bail, there is likelihood of tampering with the witnesses, hence this Court is not inclined to grant bail to the petitioner.
