J U D G M E N T

(Judgment of the Court was delivered by N.KIRUBAKARAN, J) The appeal has been preferred by the husband against the dismissal of the divorce petition filed by him in the Family Court, Chengalpet.

2.The appellant got married to the respondent on 17.01.2013. Thereafter, due to misunderstandings, the parties are living separately for many years which compelled the appellant to file a divorce petition in F.C.I.D.O.P.No.23 of 2016 on the file of the Family Court, Chengalpet. On contest, the said Court dismissed the petition against which the present appeal has been filed. 3.When the matter is called today, both the parties are present and they categorically stated that they have decided to part ways and they agreed to get divorce by consent, withdrawing the allegations made against each other. A Demand Draft vide D.D.No.501276 dated 08.08.2019 for a sum of Rs.6,00,000/- drawn on ICICI Bank, Selaiyur https://hcservices.ecourts.gov.in/hcservices/

Branch in favour of the respondent has been handed over by the appellant in the Court as full and final settlement. 4.The Jewels weighing about sixty five sovereigns belonging to the respondent which had been kept in the Locker of Indian Overseas Bank, Tambaram Branch in the joint account, were taken back yesterday by both the parties and was handed over to the respondent, which fact is admitted by the respondent who is present before this Court.

5.The parties have also filed joint memo of compromise dated 08.08.2019 signed by both the parties, counter signed by both the Counsel giving the details of settlement as stated above. In view of the categorical statements made by both the parties before the Court as stated above, the order of the trial Court dismissing the F.C.I.D.O.P.No.23 of 2016 is set aside and decree of divorce is granted by consent. The Joint memo of compromise shall form part of the decree and Judgment.
