O R D E R
This Writ Petition has been filed seeking a direction to the respondents to draw an eligible panel for promotion of Assistant Engineers to Assistant Executive Engineers by reserving the post for persons with benchmark disabilities as per G.O.Ms No.6 dated 21.06.2025, Welfare of Differently Abled Persons (DAP-3.2) Department, by considering the petitioner's representations dated 12.11.2025, 03.12.2025 and 15.12.2025.
2. Heard the learned counsels on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.
3. The learned counsel for the petitioner submitted that the petitioner is a differently abled person with 40% locomotor disability and entered the service as an Assistant Engineer by direct recruitment at Tirunelveli Division
and now working at Tirupur Division. He added that following the Government of India Memorandum dated 29.12.2005, G.O.Ms.No.200, SW & NMP Department dated 22.12.2006 was issued by the Tamil Nadu Government to follow 100 point roster wherein for each 33 vacancies, one differently abled person has to be selected and also pursuant to the directions of this Court dated 27.04.2012 passed in W.P.Nos.15550, 15770 & 15777 of 2004, G.O.Ms.No.5 came to be issued and thereafter, reservation in promotion was also brought into implementation vide G.O.Ms.No.6 dated 21.06.2025. He further submitted that the respondent Board had also commenced the process of preparing the panel for promotion to the post of Assistant Executive Engineer for the year 2025 and the petitioner made representations dated 03.12.2025 and 15.12.2025 to reserve the post as per G.O.Ms.No.6 dated 21.06.2025, as he is a person with benchmark disabilities warranting reservation of post and for grant of the aforesaid relief, the petitioner has come forward with the present Writ Petition. Thus, he prayed to pass appropriate orders.

Considering the facts and circumstances of the case and also in the light of the Government Order in G.O.Ms. No.6 dated 21.06.2025, this Court directs the third and fourth respondent to consider the representations of the petitioner dated 12.11.2025, 03.12.2025 and 15.12.2025 and pass appropriate
orders prior to the approval of the promotional panel in accordance with law, if not already passed, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. There shall be no orders as to costs.
