ORDER

The petitioner, who was arrested and remanded to judicial custody on 21.05.2025 for the offences punishable under Sections 191(2), 191(3), 329(4), 296(b), 115(2), 118(1), 109(1), 309(5), 351(3) and 61(2) of BNS in Crime No.348 of 2025, registered on the file of the respondent police, seeks bail. This is the second bail application of the petitioner and the earlier bail application of the petitioner was dismissed by this Court, vide order dated 19.11.2025 in Crl.O.P.No.31619 of 2025.

The allegation against the petitioner is that, the petitioner along with other accused demanded money from the defacto complainant and his father; that since the same was not given, they attacked the defacto complainant and others indiscriminately inflicting cut injuries, which resulted in severe injuries. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case; that subsequent to the dismissal of the earlier bail application of the petitioner in Crl.O.P.No.31619 of 2025, the co-accused in this case were granted bail by this Court, vide orders dated 19.12.2025 and 26.12.2025 in Crl.O.P.Nos.34987 and 35907 of 2025, respectively; that the petitioner is in custody since 21.05.2025 and he 2/4

is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the investigation of the case was completed and now the final report has been filed and the same is yet to be numbered; that the petitioner has 12 previous cases.

Considering the submissions made on both sides, facts and circumstances of the case and though, the learned counsel appearing for the petitioner submitted that the co-accused in this case were granted bail by this Court, it cannot be considered as a change in circumstances. 6.

Considering the above facts, the nature of offence, the previous antecedents of the petitioner and the fact that there is no change in circumstances after the dismissal of the earlier bail application of the petitioner in Crl.O.P.No.31619 of 2025, this Court is not inclined to grant bail to the petitioner.
