ORDER

This Writ Petition has been filed praying to quash the order passed by the 2nd Respondent in his Na.Ka.No.A2/1461/2023, Sa.A.No.129/2023 dated 16.10.2023.

The learned counsel appearing for the petitioner would submit that the petitioner is working as Sub Inspector of Police, Chengalpet Railway Police Station, Chennai Railway Police District. The third respondent issued charge memo under Rule 3 (b) of Tamilnadu Police Subordinate Services(Discipline and Appeal) Rules on 18.11.2022 for not conducting proper investigation with regard to missing of gold bracelet. Subsequently, enquiry was conducted and punishment was imposed as 'postponement of increment for one year, operate postponement of future increments'. Challenging the same, this writ petition has been filed.

The learned counsel appearing for the petitioner would further submit that as against the impugned order, the petitioner preferred appeal before the appellate authority dated NIL. However, this Court may issue direction to the first resopndent to dispose of the appeal filed by the petitioner within a reasonable time as fixed by this Court and permit the petitioner to send the appeal copy along with the order of this Court to enable the first respondent to pass appropriate orders.

The learned Additional Government Pleader appearinng for the respondents would submit that the second respondent is the appellate authority and if the appeal copy is forwarded along with the copy of this order, the second respondent will pass appropriate orders.

It is seen that as against the impugned order, there is appeal remedy available with the second respondent and the petitioner made appeal before the first respondent instead of the second respondent. Hence, the petitioner is directed to forthwith send the appeal copy along with this order copy to the second respondent to enable the second respondent to dispose of the appeal. On receipt of the same, the second respondent is directed to consider the appeal giving necessary opportunity to the petitioner and pass appropriate orders on

merits and in accordance with law within a period of twelve weeks from the date of receipt of this order.

With the above direction, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
