Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records in எண்.15915/bgh1/2024 dated 23/11/2024 on the file of Superintendent of Central Prison, Cuddalore, 2nd respondent herein and quash the same and direct the 2nd respondent to reinstate the petitioner will all benefits as Grade II Warden in Central Prison, Cuddalore.

ORDER

This writ petition is filed to call for the records in எண்.15915/bgh1/2024 dated 23/11/2024 on the file of Superintendent of Central Prison, Cuddalore, 2nd respondent herein and quash the same and direct the 2nd respondent to reinstate the petitioner will all benefits as Grade II Warden in Central Prison,

2. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

The case of the petitioner is that he was appointed as a Grade-II Warden and due to an accident, he was not able to attend the duty for more than 21 days, thereby, the second respondent declared the petitioner as deserter and passed the order dated 23.11.2024. Challenging the same, the petitioner has come forward with the present writ petition. 2/5

Learned counsel for the petitioner would submit that as against the order of the second respondent dated 23.11.2024, the petitioner has preferred an appeal before the first respondent on 22.11.2025. However, no order was passed. Hence, he prayed this Court that direction may be issued to the first respondent to consider the petitioner's appeal dated 22.11.2025.

5. Learned Special Government Pleader appearing for the respondents has acceded to the submission made by the learned counsel for the petitioner.

6. Heard the learned counsel on either side and perused the materials available on record.

In view of the above submission made by the learned counsel for the petitioner, this Court without interfering with the order impugned dated 23.11.2024, directs the first respondent to consider the petitioner's appeal dated 22.11.2025, after affording an opportunity of hearing to the petitioner and pass appropriate orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order. 3/5
