Section 136 of the Tamil Nadu Urban Local Bodies Act, 1998, within a time frame fixed by this Court.

ORDER

Heard Mr.Ramanujam Vedhanarayanan for Mr.P.Dinesh Kumar for the petitioner. Mr.E.C.Ramesh, learned Senior Counsel for respondents 1 to 4. Dr.G.Krishnamoorthy for Mr.A.K.M.Samsunihar for respondents 5 and 6. 2.The petitioner alleging that the building is in a dilapidated and ruinous condition approached the second respondent calling upon him to invoke under Section 136 of the Tamil Nadu Urban Local Bodies Act, 1998. The second respondent passed an order on 22.09.2025 to the said effect. In order to implement the said order the petitioner has moved this Court. 3.I entertained the Writ Petition on 19.12.2025 and called upon the petitioner to serve notice on respondents 5 and 6, namely, the tenants in the occupation of the property. I listed the matter on 30.01.2026. 4.Today, the learned counsel for the private parties made a mention stating that the respondents 5 and 6 have agreed to vacate and handover

possession of the property. A separate affidavit to that effect has been filed by respondents 5 and 6. The same are scanned and extracted hereunder:-

5.As tenants have agreed to vacate and handover possession within a period of one week from today the time has granted till 16.02.2026 for the respondents 5 and 6 to vacate the premises and handover possession to the writ petitioner. The corporation shall not initiate any demolition proceedings till 16.02.2026. Dr.G.Krishnamoorthy appearing for Mr.A.K.M.Samsunihar states that the suits in O.S.No.6096 of 2025 and O.S.No.6122 of 2025 on the file of XVII Assistant City Civil Court, Chennai, would be withdrawn by respondents 5 and 6 on the next day of hearing. His statement is recorded. Dr.G.Krishnamoorthy made a request that a direction may be issued to the writ petitioner to accommodate the respondents 5 and 6 in the newly constructed building. It is up to the trustees to take a call on the said effect.
