PRAYER: Writ petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for records relating to the Impugned order in A2/ 3851/ 2025 dated 26.09.2025 on the file of the 3rd respondent and quash the same and consequently direct the 3rd Respondents to issue consent letter to the petitioners as eligible persons to receive the compensation awarded for their land acquisition by vide notice in Na.Ka.No. A2/ 324/ 2021 dated 03.02.2025 on the file of the 4th Respondent. ORDER

By notice of award dated 03.02.2025, it was communicated that in respect of the relevant survey numbers, the persons claiming ownership should obtain the consent of the third respondent so as to receive the compensation by approaching the Principal District Judge, Thiruvannamalai. In relation thereto, the petitioners filed W.P.No.18543 of 2025 before this Court. By order dated 05.06.2025, this Court permitted the petitioners to approach the Revenue Divisional Officer for consent. The petitioners were also permitted to __________Page 2 of 5

thereafter approach the Principal District Judge, Thiruvannamalai. The order impugned herein was issued thereafter.

2. By referring to the earlier order of this Court and the impugned order, learned counsel for the petitioners submits that the Sub Collector declined to entertain the request on the ground that a specific direction had not been issued by this Court.

3. Learned Additional Government Pleader accepts notice on behalf of respondents 1 to 4 and Mr.Palaniappan, learned standing counsel accepts notice for the fifth respondent. Learned Additional Government Pleader fairly submits that the impugned order is not in consonance with the earlier order of this Court.

4. By order dated 05.06.2025, as noticed earlier, this Court held that the petitioners shall approach the Revenue Divisional Officer / Sub Collector and thereafter the Principal District Judge, Thiruvannamalai. In view of such order, the Sub Collector was under an obligation to duly consider the request for consent and pass orders thereon. Instead, the Sub Collector has rejected the request on the ground that no specific direction was issued. This approach cannot be countenanced. Consequently, the impugned order is set aside and the __________Page 3 of 5

matter is remanded to the Sub Collector for consideration and disposal on merits. This exercise shall be completed within one month from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioners. No costs. Consequently, the connected writ miscellaneous petitions are closed.
