ORDER

This petition has been filed seeking a direction to the 1st respondent herein to consider and pass orders on the representations of the petitioners association

herein on 29.09.2025 to 1st respondent herein for making allotment of suitable places or relocation of suitable places in continuation of running kiosk by the NAESEY members in the list of places enclosed herewith and also.

2. It is the case of the petitioner that on 20.06.1976 the petitioner's association viz., NAESEY was registered under the Societies. Act vide Registration No.222 of 1976. The petitioner Association was formed under chapter IV of the Consitition of India relating to promotion of Cooperation society for democratic control and professional management of the cooperative societies. Therefore, all the members of the petitioner's association have right to enforce directive principles of state policy. In the meanwhile, the Government issued GO.No.2055 dated 30.10.1987, directed to remove all the members of the petitioner's association. Challenging the said GO, the petitioner's association filed a writ petition before this Court and the some was dismissed. Challenging the said order, the petitioner has filed SLP and same was also dismissed.

The petitioner association made a several representation to the respondents seeking allotment for relocation of places in Medical institution to run the kiosk. However, the same is not considered and therefore, the petitioner filed the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Government Advocate appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 29.09.2025 within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. No costs. Index; Yes/No 13-03-2026 Speaking/Non-speaking order RLI
