Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 3rd and 4th respondents herein to conduct survey and fix the boundary stones for petitioner's property comprised in Survey No.855/3 in 1240 square feet within the boundaries of Periyanaickenpalaiyam Village, Coimbatore District by considering petitioner's representation dated 09.12.2025 For Petitioner : Mr.R.Subramanian For Respondents 1 to 4 : Mr.R.P.Murugan Raja Government Advocate Respondent- 5 : Notice Dispensed with 1/4
Order This Writ Petition is taken up for final disposal at the stage of admission itself.
2. This Writ Petition has been filed seeking for a direction to the respondents 3 and 4 to survey and demarcate the property, which, according to the petitioner, is owned by her, based on her representation dated 09.12.2025 within a time frame to be fixed by this Court.
3. The petitioner had submitted a representation dated 09.12.2025 to the official respondents seeking for survey and demarcation of the property morefully described in the prayer to this Writ Petition. Since the said representation has not been considered till date, the petitioner has filed this Writ Petition.
4. Mr.R.P.Murugan Raja learned Government Advocate accepts notice on behalf of the respondents 1 to 4. Since no adverse orders are passed against the private respondent, viz., fifth respondent, notice to him is dispensed with in this Writ Petition by this Court. 2/4
5. No prejudice will be caused to the official respondents, if the aforesaid representation of the petitioner is considered on merits and in accordance with law, after hearing the objections, if any, from the fifth respondent as well as any other party, whom, the third respondent deems it fit to enquire. Accordingly, this Writ Petition is disposed of in the following manner:- (a) Before surveying the lands in question, the third respondent is directed to issue notice to the fifth respondent and also to any other party, whom, the third respondent deems it fit to enquire.
b) After receiving objections, if any, and after considering the same, the third respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
No Costs.
