The impugned order dated 05.12.2025 vide proceedings Na.Ka.3712/2025/Ptho passed by the first respondent authority, is put under challenge in the present Writ Petition. Further, the petitioner has sought for a direction to the respondent authority to consider her request and willingness made to the previous transfer order dated 01.09.2025.
2. Heard the learned counsels on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself. 3.The brief facts of the case is as follows:
3.1. The petitioner was appointed as Senior Inspector through direct recruitment and has been working under the control of the Joint Registrar of Co-operative Societies, Namakkal Zone and now working as Field Officer, Sendamangalam Circle until early 2025. While so, due to personal vendetta, the petitioner was transferred to the post of Co-operative Sub Registrar, Salem District through proceedings dated 08.04.2025 and was relieved on 07.05.2025. In this regard, the petitioner made representation to the respondent authority to re-consider her transfer on 23.06.2025 stating her health issues and family circumstances. In this backdrop, the petitioner filed
a writ petition in W.P.No.27439 of 2025 and this Court had disposed the same on 07.08.2025 to consider the case of the petitioner on sympathetic grounds and pass orders within a period of two weeks. However, on 14.07.2025, the respondent herein had passed the order directing the petitioner to join duty in the transferred place, for which the petitioner made a representation on 20.08.2025 along with the online copy of the aforesaid writ order to consider her request afresh. However, the same was rejected. The petitioner again preferred another writ petition in W.P.No.38155 of 2025 challenging the said transfer order, but the same was dismissed by this Court, leading to the filing of an appeal in W.A.
3421 of 2025 by the petitioner however, the same was withdrawn on the pretext that the respondent authority may consider her representation on humanitarian basis. Subsequently, the petitioner approached the respondent authority giving consent for her transfer but without considering her consent, due to personal vendetta, the respondent cancelled the previous transfer and transferred the petitioner to Tiruchirappalli on 05.12.2025. Aggrieved by the same, the petitioner has come forward with the present Writ Petition.
4. The learned counsel for the petitioner submitted that the petitioner has health issues and also that she has to take care of her aged parents and daughter, who is preparing for XII board examination. He also submitted
that the transfer of the petitioner is only on personal vendetta and not on administrative grounds. He further submitted that considering her medical issues and family situations, there may be a direction to the respondents to consider her transfer request and thus, prayed this Court to pass appropriate orders.

Per contra, the learned Government Advocate appearing on behalf of the respondents submitted that by considering the petitioner's request, the respondent has revived the previous transfer order and transferred her to Tiruchirappalli on 05.12.2025. Apart from that, he contended that the petitioner's relative had threatened the second respondent in regard to her transfer. He also submitted that the transfer of the petitioner is only on administrative grounds and hence, the same warrants no interference by this Court.
6. I have considered the rival submissions made by the respective learned counsels and also perused the materials available on record.
7. On perusal of the case records reveals that the petitioner has medical ailments and as a single parent, she has to take care of the studies of her daughter, who is preparing for Higher Secondary Board examination and
also her aged parents. This Court by considering the above facts, directs the respondents to permit the petitioner to continue her duty at Namakkal till 01.06.2026 and thereafter, to join the duty at the transferred place, Tiruchirappalli. However, the petitioner is directed to file an affidavit before the first respondent to the aforesaid effect.
7. With the above observations and directions, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. There shall be no orders as to costs.
