ORDER
This is a petition filed by the petitioner seeking a direction to the respondent Railway as well as the REMCL to give 46 acres of land that was identified by the Railways to the petitioner for the circular train for the manufacture of mechanical power energy to the benefit of the Government of India.
2. Heard the learned counsel for the petitioner and the learned Senior Central Government Standing Counsel accepting notice for the third respondent. In view of the limited nature of the relief this Court
proposes to grant, notice to respondents 1 and 2 is dispensed with and the writ petition itself is taken up for final disposal.
3. The case of the petitioner is as follows:
(i) The petitioner claims himself to be an inventor. He has obtained many patents. He has also got all the certificates of patent right. The petitioner has invented mechanical power plant in India, with which, three types of energy namely solar, wind and mechanical energy can be produced. The Railways is using wind energy while the train is being run through generators.
(ii) The petitioner filed W.P.No.15825 of 2015 before this Court seeking to direct the General Manager, Southern Railways, Chennai to consider the representation of the petitioner dated 30.12.2013 to enable the wind energy to be useful to the human society in our country. The said writ petition was disposed of on 05.6.2015 with a direction to the General Manager, Southern Railways, Chennai to consider the said representation within a time frame.
(iii) Though the Government of India has been using the
mechanical electricity energy invented by the petitioner, he has not been paid any royalty or compensation for the power of energy that has utilised so far. The petitioner wants India to be the first beneficiary from the mechanical power plant. The second respondent is the only office authorised organisation to lease out the properties belonging to the Railways.
(iii) The second respondent identified 46 acres of land at Arakkonam and Thiruparankundram. The said 46 acres of land could be leased out for the purpose of manufacturing renewable energy. The said properties are required to manufacture renewable energy with the patent rights of the petitioner namely circular train wind power generation. In this writ petition, the petitioner seeks a direction to the Railways to give him 46 acres of land for manufacturing power energy.
4. In fine, the petitioner is seeking to allot the 46 acres of land identified by the Railways for manufacturing the mechanical power energy.
5. In the considered view of this Court, the prayer sought for by the petitioner cannot be granted. The respondents may even propose to conduct an auction by due process, which is within the entire domain of the respondents. This Court, exercising its jurisdiction under Article 226 of The Constitution of India, cannot grant such a relief to the petitioner.
6. Hence, the writ petition is dismissed. It is needless to point out that it is always open to the petitioner to participate in the auction, if any, conducted by the respondents in future. No costs. 10-04-2026 Index: Yes/No Speaking/Non-speaking order To
