O R D E R

This Writ Petition has been filed seeking a direction to the respondent to disburse the belated payment of interest amount of provident fund, gratuity, commutation and earned leave salary amounts and other unsettled benefits of surrender leave salary for the year of 2009-2011 & 2016-2019, difference amount gratuity and earned leave salary as per 12(3) wage settlement with effect from 01.03.2024, within a time limit as fixed by this Court.

2. It is the case of the petitioner that he joined the service of the respondent Corporation on 05.02.1987 and retired on 29.02.2024. However, the terminal benefits have been settled belatedly. Therefore, the petitioner claimed to disburse the belated payment of interest amount of provident fund, gratuity, commutation and earned leave salary amounts and other

unsettled benefits of surrender leave salary for the year of 2009-2011 & 2016-2019, difference amount gratuity and earned leave salary as per 12(3) wage settlement with effect from 01.03.2024 and he has also made representation on 11.11.2025, which has not evoked any response so far. Hence, the present Writ Petition.

3. Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

In view of the limited request made by the petitioner with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits from the date of retirement to till the date of actual disbursal of the retirement benefits of the petitioner and also to consider the issue in regard to disbursement of the earned leave salary and other unsettled benefits of surrender leave salary for the year of 2009-2011 & 2016-2019, difference amount gratuity and earned leave salary as per 12(3) wage

settlement with effect from 01.03.2024, if there is no other impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.

5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
