respondents to forthwith consider and dispose of the petitioner's detailed Representation dated 10.12.2025 and consequentially direct that the investigation in Crime No.427 of 2025 on the file of the J-2 Adyar Traffic Investigation Wing, Chennai relating to the death of Late Advocate R.Sivamoorty, be taken over and supervised by a senior police officer not below the rank of Assistant Commissioner of Police/Deputy Commissioner of Police, by ensuring retrieval preservation and scientific analysis of all CCTV footage in and around the place of occurrence collection and examination of 108-EMRI ambulance,call records and police patrol logs, proper spot inspection and mechanical examination, and by reconsidering the mechanical invocation of Section 281 of the Bharatiya Nyaya Sanhita, 2023. ORDER
Alleging that the investigation in respect of the death of her husband in a road accident has not been done properly by the respondent police, the petitioner has come forward before this Court by way of the present Writ Petition.
2. The petitioner has sent a detailed representation dated 10.12.2025 to the respondents to take action. Since no action has been taken, the present writ petition has been filed.
3.When the matter is taken up for hearing today, the learned Additional Public
Prosecutor appearing for the respondents would submit that the fourth respondent is conducting the investigation. He would further submit that no CCTV footages were available around the place of the alleged accident. However, during the course of investigation, based on the information given by one Kumar, Bank Manager, it was found that accident has been caused by 108 ambulance driver, namely, Murali and he has been arrested and enlarged by Station bail. He would further submit that the investigation is being conducted in a proper manner and he would ensure that the final report will be filed at the earliest possible. 4.In view of the above, this petition stands disposed of with a direction to the Assistant Commissioner, Adyar to monitor the investigation conducted by the fourth respondent in crime no.427 of 2025 on the file of the J-2, Adyar Traffic Investigation Wing, Chennai and after completion of the investigation, the fourth respondent shall file the final report before the concerned Court. 06-01-2026 dn Index:Yes/No
