Prayer: Civil Miscellaneous Appeal filed under Section 19(1) of the Family Courts Act, 1984 against the order dated 27.4.2018 in I.A.No.1550 of 2017 in O.P.No.548 of 2017 on the file of the Principal Judge, Family Court, Chennai.
For appellant : Mr.J.Saravanavel For respondent : Ms.Inthu Karunakaran
JUDGMENT
(Judgment of the court was made by R.SUBRAMANIAN,J.) Challenge in this appeal is to the order of the Family Court, Chennai directing the husband to pay interim maintenance of Rs.15,000/- per month.
2. The admitted fact is that there is a child out of the marriage and the child is also living with the wife. The husband has produced Income Tax Returns which shows that he has a taxable income of Rs.3,08,900/-. Taking into account the fact that the husband belongs to a family of Traders and he is also having separate business, the Family Court had fixed the interim maintenance at Rs.15,000/- per month.
3. Considering the reasons assigned by the Family Court, we do not think that the quantum of maintenance arrived is on the higher side and we do not see any reason to interfere with the same. Hence, the civil miscellaneous appeal fails and the same https://hcservices.ecourts.gov.in/hcservices/
is dismissed. No costs. The connected miscellaneous petition is also dismissed.
