O R D E R
The present Writ Petition has been filed seeking a direction to the first respondent herein namely, the DIG of Prisons, Coimbatore Range, Coimbatore to consider and pass a detailed order on merits and in accordance with law on the appeal petition dated 23.09.2025 submitted by the petitioner, within a time frame as fixed by this Court.
2. Heard the learned counsels on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

The learned counsel for the petitioner submitted that the petitioner is an Ex-II Grade Warder, who entered the service on 01.12.2018 and while so, during inspection, it was found that the petitioner had assisted the accused to have cell phone with him and hence, he was placed under suspension from 27.09.2023 by the second respondent and pursuant to the suspension, a charge memo was issued on 25.10.2023. He contended that the petitioner made representations to the second respondent to furnish the copies of the necessary documents so as to defend his case but the same was denied to him. Furthermore, the third respondent was appointed as inquiry officer to conduct the departmental inquiry against the petitioner and the
second respondent through his proceedings dated 14.03.2024, communicated about the enquiry report dated 13.03.2024 which holds that the charges were proved against him. However, the petitioner through RTI Act, received the documents from the respondent and perusal of the same showed that he was not at all on charge at the time and date of occurrence. He added that when the petitioner has sought time to submit his written statement of defence to the charge memo and thereafter to proceed with the inquiry against him, no response from the respondents and was dismissed from service, for which he had filed an appeal before the first respondent on 27.05.2024. He continued that the petitioner filed a petition in W.P.No.4212 of 2025 to consider his appeal and this Court by its order dated 10.02.
2025, disposed of the petition, by directing the respondents to complete the enquiry within four months based on the order passed in the appeal and also directed the petitioner to cooperate with the enquiry, however, the same punishment was again imposed on him which led to file an appeal dated 23.09.2025. He further submitted that it would suffice to direct the first respondent to dispose of the appeal filed by the petitioner dated 23.09.2025, within the prescribed time.
4. Considering the submissions made by the learned counsel for the petitioner, this Court directs the first respondent to consider and dispose of the appeal filed by the petitioner dated 23.09.2025 on merits and in
accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition is disposed of. There shall be no orders as to costs.
