ORDER
This petition has been filed to set aside the order dated 19.11.2025 passed in Crl.M.P.No.3155 of 2025 in Crime No.240 of 2024 by the learned Principal Sessions Judge, Krishnagiri.
2. The learned counsel for the petitioner submitted that the petitioner was granted bail in the following crime numbers:
Crl.M.P.No. 2571/2025 (Crime No.85 of 2025, Bargur P.S.) Crl.M.P.No. 2977/2025 (Crime No.240 of 2024, Mathur P.S.) Crl.M.P.No. 2959/2025 (Crime No.242 of 2024, Mathur P.S.) Crl.M.P.No. 2968/2025 (Crime No.336 of 2025, Mathur P.S.) He further submitted that, in respect of the Crime No.85 of 2025, the bail was granted in Crl.M.P.No.2571 of 2025 with a condition that the petitioner shall appear and sign before the Mathur Police Station daily at 9.00.a.m. In connection with other cases, petitioner was directed to appear before the Mathur Police daily at 09.00.a.m., for a period of thirty days. Since the petitioner was directed to appear two different police station at same time, he filed petition for modification of the said conditions, before Sessions Court. But the Sessions Judge, though not inclined to modify condition, strangely cancelled the bail 2/5
granted to petitioner, which is violation of principles of natural justice, hence, this petition is filed to set aside the same.
3. I have gone through the materials available on record. It revealed that the petitioner was directed to appear before the Bargur Police Station in respect of Crime No. 85 of 2025 and in respect of other Crime Numbers, the petitioner was directed to appear before the Mathur Police Station. It is impossible for the petitioner to appear before two different police Station on the same time. The Principal Sessions Judge, without considering the above factual situation and without modifying the said condition, has cancelled the bail to the petitioner in Crime No.240 of 2024 and in Crime No.85/2025, 242/2024 and 336 of 2025 without issuing proper notice to the petitioner and without seeking explanation for the petitioner's non-compliance.
Hence, I am of the view that, the Principal Sessions Judge, Krishnagiri, has exceeded his jurisdiction and cancelled the bail granted to the petitioner. Therefore, the order passed by the learned Principal Sessions Judge, Krishnagiri in Crl.M.P.No.3155 of 2025 is hereby set aside, and the petitioner is hereby directed to appear before the Inspector of Police, Mathur Police Station, Krishnagiri District, daily at 09.00 a.m., in respect of Crime No.240 of 2024 for the period of 30 days.
